Terms and Conditions

Introduction

Pageticker is designed to help teachers and parents develop a reading-for-pleasure culture in their school.

 

Pageticker has been developed by Pedalogic Ltd, an education technology company based in Bath, UK, with the mission of providing low-cost, high-impact solutions to schools.

 

Please note:

 

  • Use of Pageticker by your school constitutes acceptance of the Terms and Conditions

  • If your school does not accept the Terms and Conditions, you should not use Pageticker.

  • Acceptance also constitutes your instruction to us to process School Data (as defined below) for the purposes of your use of Pageticker. We will only process School Data in accordance with the instructions set out in the Data Handling Agreement.

Trial Agreement

We are pleased to give you access to Pageticker for the purposes of evaluating the suitability of the product for your school (the Trial). 

 

Pedalogic Ltd, as developers of Pageticker, undertake to do the following during the course of the Trial:

  • Provide the Trial free of charge and unlimited by time.

  • Give one teacher access to the teacher dashboard, which will be pre-populated with one or more example student(s).

  • Provide necessary information and support via webinars and any other customer support channels to answer any queries.

 

You, as a teacher engaged in the Trial, agree to:

​

  • Sign up for the trial using your academic email address. This is to prevent misuse of our product for non-educational purposes.

  • Understand that any data created during the course of the trial is solely for the purposes of evaluation of the product, and will be deleted upon completion of the trial

  • Understand that a long period of inactivity during the trial data will result in the trial automatically being terminated with associated deletion of data.

Subscription

Should your evaluation of Pageticker be successful, a subscription can be taken in order to give your school full access to the product.

 

Subscription entitlement

 

Only schools may subscribe to Pageticker. Your subscription to Pageticker will entitle you to create accounts for all teaching staff and students at your school, and for parents to link themselves to their children’s accounts, for the purposes of logging reading activities, book discovery, and access to motivational and community features.

 

Important: as a subscriber, the only way to populate accounts for teaching staff and students is through a Wonde connection. This condition is in place in order to protect the integrity of the data in Pageticker and to provide for the best possible customer experience.

 

Subscription fee and payment

 

To preserve the low cost of our service, unless agreed, the preferred method for schools to subscribe to Pageticker is by card payment through our website.

 

The subscription fee is dependent on the size of your school. VAT will be applied if applicable.

 

All subscriptions are annually-recurring. Renewal of the subscription is automatically taken via our payment provider, Stripe. These payments will be taken on the same card you initially subscribed with.

 

The subscription will be the responsibility of the Account Holder. To future-proof your subscription, we strongly recommend that the email address used for the account holder is a generic school email address, such as bursar@exampleschool.sch.ac.uk or office@exampleschool.sch.ac.uk.

 

The subscription fee will be taken 14 days after the subscription has been taken out. If your school changes its mind about subscribing during these initial 14 days and cancels, no payment will be taken.

 

The subscription is an annually-recurring subscription. Renewal of the subscription is automatically taken via our payment provider, Stripe. These payments will be taken on the same card you initially subscribed with.

 

If you initially subscribed with a discount code, this may or may not be applied when your subscription renews, dependent on the terms and conditions with which the code was provided.

 

All teachers in the school will be notified two weeks in advance of the subscription automatically renewing, however, only the Account Holder will be able to cancel the subscription via our website. If nobody in your school any longer has access to the Account Holder email address, it is also possible to cancel by emailing support@pedalogic.com

On our part

Once you have subscribed, we will:

​

  • Provide support if you have any queries during set-up

  • Provide on-line training on our product, usually by a short webinar of no more than 15 minutes

  • Give sufficient notice of any material changes to the functionality of our product

  • Do our best to ensure that access to Pageticker is always available, except during planned maintenance for which we will provide notice, and it is our aim to achieve at least 99.9% uptime.

On your part

As a school subscriber, you are responsible for:

  • Adopting and implementing Pageticker

  • Corresponding with parents relating to the creation of their accounts on Pageticker

  • Ensuring teaching staff attend training webinars for Pageticker

  • Providing and maintaining access to your school management information system (MIS) via Wonde

  • How Pageticker is used by your school community: our product is designed to promote a positive, encouraging and tolerant reading experience for all children and as a school you are responsible for promoting this

School Data

To use the Pageticker, you need to share personal data relating to your teachers, students and (where applicable) their parents with us. We call this School Data. We use School Data to provide Pageticker by processing it in accordance with the instructions set out in the Data Handling Agreement.

Intellectual Property

We own or licence all content in the Pageticker product, including our technical architecture and discovery algorithms. You as a customer have no rights, beyond access as set out in these Terms and Conditions, to our product.

Confidentiality and Publicity

All parties agree to act in good faith to preserve the confidentiality of any information shared in relation to the provision of Pageticker. We at Pedalogic Ltd regard all personal information and any commercial aspects of our relationship as confidential. We do not regard the fact that you are using Pageticker as confidential, and may share this fact publicly unless expressly requested not to do so.

Liability

In any relationship, there are risks and we need to be responsible for our fair share. We hold suitable insurance to cover our liabilities to you as set out in the Terms and Conditions.

  • Legal requirements: As required by law, we accept unlimited liability for personal injury and death caused by our negligence. Similarly, our liability for fraud or fraudulent misrepresentation is unlimited.

  • Suspension: Liability in respect of suspension of access to the Pageticker due to events outside our control is dealt with under ‘Problems or unexpected events’ below. We have no liability to you in the event of a suspension of access arising where our invoice has not been paid when due or we become aware of any unacceptable use.

  • Cyber risks: Liability for a security breach affecting school data caused by our negligence is limited to £100,000.

  • Intellectual property: We will indemnify you against any claim that is made by anyone in the UK challenging our ownership of, or your right to use, Pageticker. If a claim is made against your school, please tell us at once.

  • All other risks: We are responsible for your direct losses up to the amount paid by you in respect of the relevant Pageticker in the preceding twelve (12) months. We do not accept liability for any indirect or consequential loss (including damage to goodwill) you may suffer because we do not know what they are likely to be, nor quantify them. We are not responsible for any fault, error or delay caused by you failing to give us the information we need or failing to carry out any of your responsibilities to us in respect of Pageticker. We are also not responsible for any loss, destruction, alteration or disclosure of school data caused by any third party (except our subcontractors or support companies), your teachers, your students and their parents or by circumstances beyond our control.

Problems or unexpected events

The performance of Pageticker depends on a number of factors, many of which are outside our immediate control, and we cannot promise that Pageticker will be error-free. Whilst we are happy to assist you with such issues, we cannot provide fixed assurances about the exact performance experienced by users, except that we will provide sufficient capacity and bandwidth in our system environment to allow for all normal usage demands. If we suspend access to Pageticker due to an event outside our control, whether due to malicious action or otherwise, then, if this suspension lasts more than fourteen (14) days, we will refund a pro-rata amount of your subscription fee for those fourteen (14) days and each further consecutive day that access is suspended. We shall not be under any further liability to you in respect of such suspension. If the suspension lasts for a continuous period of fifty-six (56) days, then you may immediately terminate your subscription and we will refund any subscription fees paid in advance for the period starting from the beginning of the fifty-sixth (56th) day suspension to your renewal date. If either of us fail to carry out our responsibilities then, provided the one who is failing has been given a written warning and a reasonable chance to fix it, the other may end your subscription by giving thirty (30) days written notice.

Complaints and disputes

If you are not happy with any aspect of Pageticker, the matter should be raised with the support team at Pedalogic. If the matter relates to data protection, then it shall be immediately escalated to our Data Protection Team. We will endeavour to resolve any issues in a timely, reasonable and respectful manner.

Jurisdiction

These Terms and Conditions shall be interpreted and governed in accordance with the laws of England.
